Terms & Conditions – Visually Rich Travel

These Terms & Conditions (“Agreement”) govern the relationship between Visually Rich
Travel (“Planner,” “we,” “our,” or “us”) and the client (“you,” “your,” or “traveler”) engaging
our professional travel planning services. By paying for and/or using our services, you agree to
be bound by the following terms:

1. Scope of Services
• Visually Rich Travel provides professional travel planning, consultation, and
itinerary design services.
• Our services may include destination research, accommodations and transportation
recommendations, excursions, vendor referrals, and booking assistance (where
applicable).
• We act solely as a travel planner and consultant. We do not own, operate, or control the
third-party providers (airlines, hotels, tour operators, cruise lines, transportation
companies, etc.) that fulfill your travel arrangements.

2. Planning Fees & Payments
• All travel planning fees are nonrefundable (see Refund Policy).
• Payment of planning fees is required before services begin.
• Additional service fees may apply if you request services beyond the original scope of
work.
• Trip deposits, vendor payments, and final balances are subject to each third-party
supplier’s terms and conditions.

3. Refunds & Service Credits
• Planning fees are nonrefundable but may be applied as a service credit for up to one (1)
year from the date of payment, as outlined in our Refund Policy.
• Refunds, cancellations, or credits for travel costs (e.g., flights, hotels, tours) are governed
exclusively by the policies of the individual travel supplier.

4. Client Responsibilities
• Provide accurate and complete personal information (including names as listed on
passports, dates of birth, contact details, and travel preferences).
• Review all booking confirmations and documents promptly to verify accuracy.
• Ensure you have valid passports, visas, entry requirements, vaccinations, travel
insurance, and any other required documentation.
• Notify us of any special needs, accessibility requirements, or medical conditions relevant
to your travel.
• Comply with all deadlines for deposits, balances, and paperwork submissions.

5. Travel Insurance
• We strongly recommend that all clients purchase comprehensive travel insurance
covering trip cancellation, interruption, medical expenses, emergency evacuation,
baggage loss, and other unforeseen circumstances.
• Visually Rich Travel is not responsible for any losses or expenses incurred due to lack of
insurance coverage.

6. Third-Party Suppliers
• We act as an independent travel planner and not as an agent of any airline, hotel, cruise
line, or tour operator.
• We are not liable for the acts, omissions, errors, or negligence of third-party suppliers,
nor for any personal injury, illness, property damage, loss, accident, delay, or other
irregularities caused by such suppliers.
• All bookings are subject to the terms, conditions, and liability waivers of the supplier.

7. Cancellations & Changes
• Client-requested cancellations or changes may result in penalties or fees as determined by
third-party suppliers.
• Visually Rich Travel’s planning fees are not refundable or transferable in the event of
cancellation.
• If you wish to change travel dates, destinations, or arrangements, additional planning fees
may apply.

8. Force Majeure
Visually Rich Travel shall not be held responsible or liable for any delay, cancellation, or
disruption of services due to events beyond our reasonable control, including but not limited to:
• Natural disasters, pandemics, or public health emergencies
• Acts of government, travel restrictions, or border closures
• Strikes, labor disputes, or airline disruptions
• War, terrorism, or civil unrest

9. Limitation of Liability
• To the fullest extent permitted by law, Visually Rich Travel’s liability shall be limited to
the amount of the planning fee paid for services.
• We are not liable for indirect, incidental, consequential, or punitive damages related to
your travel.
• Participation in any activity or excursion is at the traveler’s own risk.

10. Accessibility Commitment
• Visually Rich Travel strives to ensure accessibility and inclusivity in all planning
services (see our Accessibility Statement).
• We will make reasonable efforts to connect you with vendors offering ADA-compliant
accommodations and accessible travel options, though availability cannot be guaranteed.

11. Privacy & Data Protection
• We respect your privacy and comply with applicable data protection laws.
• Personal information provided for travel planning will be used solely for booking,
communication, and service delivery purposes.
• We do not sell or disclose personal information to third parties, except as necessary to
fulfill travel arrangements.

12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of
Texas, without regard to conflict of law principles.

13. Acknowledgment of Terms
By paying for planning services and/or confirming travel arrangements with Visually Rich
Travel, you acknowledge that you have read, understood, and agreed to these Terms &
Conditions.
